1. Website Operator
xyrphos.com is operated by XYRPHOS LIMITED, a private limited company registered in England and Wales. Our website offers women’s ready-to-wear clothing, dresses, jumpsuits, casual clothing, and selected made-to-order or personalized items where clearly stated on the product page.
2. Products and Services
We make reasonable efforts to display product names, descriptions, prices, colors, sizes, materials, and availability accurately. Product images are provided for reference. Actual colors may vary slightly because of screen settings, lighting, photography, and fabric differences.
Some products may be standard ready-to-wear items, while some items may be made-to-order, custom, or personalized. Where an item has special order conditions, this will be stated on the product page, order page, or relevant policy page.
3. Pricing, Currency, and Availability
All prices are displayed on the website before checkout. Product prices, shipping charges, taxes, and any available discounts will be shown before you complete payment. Prices and availability may change without prior notice.
If a product is listed at an incorrect price due to a technical error or system issue, we reserve the right to cancel the affected order and issue a refund where payment has already been made.
4. Promotions, Discounts, Coupons, and Trial Offers
Any promotion, discount, coupon, sale price, free shipping offer, or special campaign will be subject to the conditions displayed with that offer. These conditions may include eligible products, minimum order value, valid dates, customer eligibility, geographic restrictions, and whether the offer can be combined with other discounts.
- Discounts have no cash value and cannot be redeemed for cash.
- Discounts are not applied retroactively to previous orders unless clearly stated.
- Free shipping applies only when it is clearly displayed on the product page, cart page, checkout page, or promotion banner.
- We do not offer paid subscription plans or automatic recurring billing unless such terms are clearly shown and accepted by the customer before payment.
5. Orders and Acceptance
After placing an order, you may receive an order confirmation email. This confirmation does not mean that the order has been fully accepted. We reserve the right to review, refuse, cancel, or refund an order if there is suspected fraud, payment risk, inventory unavailability, incorrect pricing, incorrect customer information, shipping restrictions, or violation of these Terms.
6. Payment
We accept Visa and Mastercard through secure third-party payment processing services. By submitting payment information, you confirm that you are authorized to use the selected payment method. We do not store full card numbers on our website.
7. Shipping and Delivery
Shipping time, shipping fees, destination restrictions, and delivery estimates are explained in our Shipping Policy. Delivery times are estimates and may vary due to customs, local carrier conditions, holidays, weather, remote locations, or other circumstances outside our control.
8. Returns, Refunds, and Cancellations
Return, refund, exchange, cancellation, and partial refund conditions are explained in our Refund, Returns & Cancellation Policy. Customers should review that policy before placing an order, especially for made-to-order, personalized, final sale, or hygiene-sensitive items.
9. Customer Responsibilities
You agree to provide accurate billing, shipping, contact, and payment information. You are responsible for checking product details, size information, shipping address, and order information before submitting your order. We are not responsible for delivery failure caused by incorrect or incomplete information provided by the customer.
10. Intellectual Property
All website content, including text, layout, graphics, images, logos, product descriptions, and design elements, is owned by or licensed to XYRPHOS LIMITED unless otherwise stated. You may not copy, reproduce, distribute, or commercially exploit our website content without written permission.
11. Prohibited Use
You may not use this website for unlawful activity, fraudulent purchases, unauthorized access, abuse of promotions, scraping, interference with website operations, or any activity that violates applicable laws or these Terms.
12. Limitation of Liability
To the maximum extent permitted by law, XYRPHOS LIMITED shall not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the website or purchase of products. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer rights.
13. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Nothing in these Terms affects any mandatory consumer protection rights that may apply in the customer’s country or region of residence.
14. Dispute Resolution, ADR, and Arbitration
All disputes arising out of or related to these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
If a dispute arises, customers should first contact us at [email protected] with the order number, issue details, and supporting evidence. We will make reasonable efforts to resolve the issue informally.
If the dispute cannot be resolved informally, either party may seek resolution through a competent court or an appropriate alternative dispute resolution process where available. Arbitration will apply only where it is legally permitted and mutually agreed by the parties in writing. Nothing in this section prevents a consumer from using mandatory legal rights or remedies available under applicable consumer law.
